This website is operated by Atelier Valenti. Throughout the site, the terms "we", "us" and "our" refer to Atelier Valenti. We offer this website, including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

By visiting our site and/or purchasing something from us, you engage in our "Service" and agree to be bound by the following Terms of Service ("Terms"), including those referenced herein and/or available by hyperlink. These Terms apply to all users of the site.

Section 1 — Eligibility

By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence (18 years of age in most US states).

To complete purchases on this website, you may be required to create a customer account or provide information during checkout. You agree to provide current, complete, and accurate information for all purchases made at our store, and to promptly update your account information (such as your email address, shipping details, and phone number) so that we can complete your transactions and contact you as needed.

We do not collect or store your full payment card information directly — all payment data is handled by our third-party payment processor(s). See our Privacy Policy for details.

You are solely responsible for maintaining the confidentiality of your account password and access codes. Atelier Valenti is not liable for loss or damage arising from your failure to safeguard your account credentials. We reserve the right to refuse service, terminate accounts, or cancel orders at our discretion if provided information is found to be false, inaccurate, or in breach of these Terms.

Section 3 — Products, Specifications, and Prices

Product descriptions: We make every effort to display colors, materials, and product images as accurately as possible. We cannot guarantee that your device's display will render colors with complete accuracy.

Pricing: All prices are listed in US Dollars (USD). We reserve the right to modify prices for products at any time; price changes do not affect orders that have already been placed and confirmed.

Pricing errors: In the rare event a product is listed at an incorrect price due to a typographical or technical error, we reserve the right to cancel the order and issue a full refund, and will notify you if this occurs.

Sales tax: Prices displayed on product pages do not include applicable sales tax. Sales tax, where applicable, is calculated and added automatically at checkout based on your shipping destination.

Section 4 — Shipping, Delivery, and Risk of Loss

Origin and timing: Atelier Valenti products are manufactured and shipped from our overseas production and fulfillment partner. Once a package reaches the United States, last-mile delivery is typically handled by USPS, UPS, or FedEx. Estimated total delivery time is [X–Y business days/weeks] from order confirmation — we display the most current estimate at checkout and on our shipping policy page, since international logistics can vary by season and destination.

If we're unable to ship your order within the stated timeframe (or within 30 days if no timeframe was given), we will notify you and give you the option to cancel for a full refund, in line with FTC requirements for mail and internet order sales.

Section 5 — 90-Day Return & Refund Guarantee

Atelier Valenti offers a 90-day return and refund guarantee on eligible purchases. The full terms — including our refund-without-return process, eligibility, and timing — are set out in our Return & Refund Policy, which forms part of these Terms. In summary: you have 90 days from delivery to request a return or refund, and in most cases you won't need to ship the item back to receive your refund, at no cost to you.

Section 6 — Disclaimer of Warranties & Limitation of Liability

THE SITE AND ALL PRODUCTS AND SERVICES DELIVERED TO YOU THROUGH THE SERVICE ARE (EXCEPT AS EXPRESSLY STATED BY US) PROVIDED "AS IS" AND "AS AVAILABLE" FOR YOUR USE, WITHOUT ANY REPRESENTATION, WARRANTIES, OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

IN NO CASE SHALL ATELIER VALENTI, OUR DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, OR CONTRACTORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE OR ANY PRODUCT PURCHASED THROUGH IT, WHETHER BASED IN CONTRACT, TORT, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES; IN THOSE STATES, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW, AND IN NO EVENT WILL EXCEED THE PURCHASE PRICE OF THE PRODUCT GIVING RISE TO THE CLAIM.

Nothing in this section limits any warranty or guarantee we expressly provide elsewhere in these Terms, including our 90-Day Return & Refund Guarantee.

Section 7 — Intellectual Property

All content on this site — including text, product descriptions, graphics, logos, images, and software — is the property of Atelier Valenti or its content suppliers and is protected by US and international intellectual property laws. Unauthorized reproduction, modification, distribution, or commercial use of this content without our prior written consent is prohibited.

Section 8 — Governing Law, Arbitration, and Class Action Waiver

Governing law: These Terms are governed by the laws of the State of New Mexico, USA, without regard to conflict-of-law principles.

Small claims option: Either party may choose to bring an individual claim in small claims court instead of arbitration, if the claim qualifies for that court's jurisdiction.

Binding arbitration: Except for small claims court matters, you and Atelier Valenti agree that any dispute arising out of or relating to these Terms, your use of the website, or a product purchase will be resolved through individual, binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. Arbitration will take place in a location reasonably convenient to you (such as your county of residence) or by other mutually agreed means, including by phone or video where available.

Right to opt out: You may opt out of this arbitration agreement by emailing contact@ateliervalenti.com within 30 days of your first purchase or account creation, stating clearly that you wish to opt out of arbitration. If you opt out, disputes will be resolved in the courts described above instead.

Class action waiver: Claims must be brought on an individual basis. You and Atelier Valenti each waive the right to participate as a plaintiff or class member in any class, consolidated, or representative proceeding, to the extent permitted by law.

Section 9 — Severability and Entire Agreement

If any provision of these Terms is found unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remainder will remain in full force and effect.

These Terms, together with our Privacy Policy and Return & Refund Policy, constitute the entire agreement between you and us regarding the Service, superseding any prior agreements or communications, whether oral or written.
